Terms and Conditions

  • Billing and Payment. The Parent agrees to pay Rose Writing Center LLC (“Rose Writing Center”) the agreed upon price for chosen teaching services online via the TutorBird Parent Portal accessible on the website www.rosewritingcenter.com.

    • Registration Fee. New families will pay a nonrefundable $25 registration fee when they sign up on the website.

    • Billing Schedule. On the 1st of each month, the family's preferred payment method will be charged the monthly fee for the class(es) in which they have enrolled their child(ren).

    • Late Payments. A late fee of $50 will be applied to any invoices not paid within 15 days of their due date. We understand that unexpected situations can arise, and in recognition of this, we will be able to waive the late fee once per family per academic year upon request. To avoid inconvenience, we recommend setting up autopay through our Parent Portal.

  • Withdrawal

    • Private Classes: Parents may request to cancel classes permanently at their convenience, with such cancellations being subject to the Cancellation Policy policy.

    • Semi-Private Classes: Parents may request to withdraw from private lessons by submitting a withdrawal request in writing via email to info@rosewritingcenter.com by the 15th of the month prior to the one in which they wish to stop lessons. For example, to stop lessons in May, parents must submit a request by April 15.

    • Group Class: Parents may request to withdraw from a group class within twenty-four (24) hours of the first class. Such withdrawal requests must be submitted in writing via email to info@rosewritingcenter.com. There is a $200 withdrawal fee per Student. Any payment processing fees which Rose Writing Center incurred for the tuition paid will not be refunded. Within ten business days of the approval of a withdrawal request, Rose Writing Center will provide a prorated refund for the monthly payment made less the withdrawal fee and payment processing charges. After twenty-four hours have passed, Rose Writing Center does not offer refunds under any circumstances.

  • Refund Policy. 

    • Rose Writing Center does not offer refunds on monthly tuition.

    • Rose Writing Center reserves the right to cancel a group class due to low enrollment. In the event that Rose Writing Center cancels a class, the Parent will be duly notified and Rose Writing Center will issue a full refund for any tuition paid to the original method of payment.

    • Summer Classes: Summer classes are non-refundable. We ask that parents schedule consultations with us to ensure that they are selecting the right class for their child. If parents are hesitant to commit to a group class, we encourage them to consider private instruction. Transfers will be permitted as long as there is space in the desired class.

  • Late Arrivals. No adjustment to class time shall be made for time lost because of late arrival by the Student or because of early termination of class by the Student. Any lost time because of the late arrival of the Instructor shall be compensated for by extending a class by mutual agreement and by such amount of time that was lost.

  • Rescheduling.

    • Private Classes. Families are responsible for making any necessary scheduling modifications in the electronic scheduling system. If they are unable to make the adjustment needed in the system for any reason, then they should email their child’s instructor with as much advance notice as possible in an effort to reach a mutually agreeable change to the schedule. While we will make our best effort to reschedule classes upon request, RWC instructors have limited availability for rescheduling due to their tightly booked schedules. As such, we cannot guarantee the availability of alternative time slots. Classes that cannot be rescheduled will be considered cancellations and therefore subject to our cancellation policy below.

    • Semi-Private and Group Classes. These class schedules are fixed for the duration of the course and will not be rescheduled except in rare circumstances. In such a circumstance, the class will not be rescheduled unless every enrolled family consents in writing to a new date and time.

  • Cancellation Policy.

    • Private Classes. If the Parent or Student cancels a class with more than 24 hours of notice, then they will receive a credit on their account that can be used toward scheduling another class, pending their instructor's availability to accommodate alternative times. If they cancel with less than 24 hours of notice, no credit will be awarded. If Rose Writing Center cancels a class for any reason, a credit will be awarded and applied to a future class mutually agreeable to Rose Writing Center and the Student.

    • Semi-Private and Group Classes. If a Student misses their class, they can make it up in accordance with our Missed Class Policy below. If the group class instructor is unavailable to teach as planned for any reason, then a substitute instructor will be assigned to teach the class. In the rare event that Rose Writing Center must cancel a group class, then an alternate makeup class will be scheduled at a time convenient for the enrolled Students.

  • Missed Class Policy for Semi-Private and Group Classes. Our program is designed to provide students with as much consistency and cohesiveness as possible, so that steady progress is made by the class as a whole. With that said, we recognize that students may occasionally have commitments that conflict with their class. Parents are asked to notify Rose Writing Center of an absence from class in advance by emailing info@rosewritingcenter.com. To make up a missed class, students have the following options. Please note that Rose Writing Center does not offer refunds for missed classes.

    1. Watch class recording, which will be shared upon request via a password-protected temporary link. Please email your child's instructor to request a recording.

    2. Join an equivalent live class held in the same week, if such a class is available. Please contact info@rosewritingcenter.com to request a list of equivalent classes.

    3. Join weekly office hours to ask questions.

  • No Shows for Private Classes. Students have fifteen minutes to arrive for their scheduled class. If a Student is running late, the Parent is encouraged to inform the instructor directly via email to both the instructor and info@rosewritingcenter.com or via phone call to (917) 426-8799. If a Student does not arrive within fifteen minutes of the class’s scheduled start time and the Instructor has not been informed that the Student is running late, then the Student will be considered a No Show, the class will be considered canceled and subject to the Cancellation Policy, and the instructor will exit the Zoom meeting.

  • Location. Classes are conducted online via Zoom.

  • Recording of Online Classes. All online classes will be recorded for the safety of Rose Writing Center instructors and the Student(s). Rose Writing Center may make recordings of group classes available to other students enrolled in the class.

  • Obligations of the Student and Honor Code. The Student will provide information for Rose Writing Center so Instructors may assess and identify writing areas in which the Student requires instruction. The Student agrees to provide their own materials needed for each class (e.g., binder, paper, writing instruments, computer, etc.). Rose Writing Center instructors takes great pride in the achievements and growth of their students' skillsets and as such, Rose Writing Center only accepts into classes Students who agree to the following:

    • The Student agrees that assignments, exercises, and homework assigned by Rose Writing Center form an integral part of tutoring and undertakes to complete such work thoroughly and promptly.

    • The Student’s answers to homework, quizzes, projects, and other assignments will be his/her own work, except for assignments that explicitly permit collaboration.

    • The Student will not make his or her solutions to homework, quizzes, projects, and other assignments available to anyone else (except to the extent that an assignment explicitly permits sharing solutions).

    • The Student will not engage in any other activities that will dishonestly improve or hurt his/her results or dishonestly improve or hurt the results of others.

  • Intellectual Property. The Parent and Student agree not to reproduce or disseminate any Rose Writing Center materials that are provided to them as students of this course. The Parent and Student recognize that lessons, worksheets, assignments, and other class materials in any form are the sole intellectual property of Rose Writing Center and agree not transmit such materials in any form or by any means, electronic, mechanical, photocopying, recording, or otherwise.

  •  Confidentiality. In the course of teaching students, Rose Writing Center may receive information considered to be confidential by its students. Upon receipt of written notification, Rose Writing Center shall not disclose such confidential information to third parties other than its staff and professionals in the normal course of business who are also bound under this confidentiality agreement.

  • No Guarantees or Warranties. This agreement is for the provision of instruction time. Rose Writing Center makes no guarantees or warranties with regard to a Student’s performance as a result of any instruction time provided. Rose Writing Center will work to help the student succeed, but test results and other outcomes depend on the Student.

  • Limitation of Liability. In the event of litigation, Rose Writing Center's total liability shall not exceed the amount of money that the Student paid Rose Writing Center for services rendered.

  • Merger Clause. This contract represents the complete agreement between the Parent and Rose Writing Center. It can only be modified in writing.

  • Other Terms & Conditions. Rose Writing Center, at its sole discretion, may cancel ongoing classes. In such a situation, the Student will not be allowed to continue booking classes and Rose Writing Center will within ten (10) business days refund to the original method of payment a pro-rated amount for all unused classes. The Student will have no recourse other than this refund.

  • Severability Clause. If any provision of this Agreement is held illegal or unenforceable in a judicial proceeding, such provision shall be severed and shall be inoperative, and the remainder of this Agreement shall remain operative and binding on the Parties.

    By checking the box on the form to accept the terms of this agreement, the Student’s parents and/or legal guardians acknowledge that no warranty or guarantee, express or implied, is made as to any student’s success or performance on any test or in any other procedure or process designed to assess a student’s intelligence, knowledge and/or academic abilities and hereby waives any such warranty or guarantee existing by operation of law. Student’s parents and/or legal guardians further acknowledge that a student’s failure to perform on any test or in any other procedure or process designed to assess a student’s intelligence, knowledge and/or academic abilities at the level expected shall not constitute a breach of this contract nor any other legally cognizable cause of action against Rose Writing Center. Student’s parents and/or legal guardians hereby release and discharge Rose Writing Center from any and all liability for injury and/or damages allegedly arising out of student’s failure to perform at any defined level on any such test or other procedure or process designed to assess a student’s intelligence, knowledge and/or academic abilities.
